Our site is hosted on Afrihost. They provide us with an online platform that allows us to sell our services to you.

We reserve the right to limit the quantities of any products or services that we offer. Accuracy Of Billing And Account Information:

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall www.hulisa.co.za, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Indemnification:

You agree to indemnify, defend and hold harmless www.hulisa.co.za and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference or your violation of any law or the rights of a third party.

Severability:

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Termination:

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

Overall Agreement:

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of The Republic of South Africa.

Refer-and-Earn-R500 Program: Terms and Conditions

1. Introduction

The “Refer-and-Earn-R500” program (“the Program”) is designed to reward individuals (“Affiliates”) who refer clients to our bookkeeping services. By participating in the Program, you agree to the following terms and conditions. These terms may be updated periodically, and your continued participation in the Program constitutes acceptance of any changes.

2. Eligibility

• The Program is open to individuals aged 18 or older who have registered as Affiliates with our bookkeeping services.
• Affiliates must comply with all local laws and regulations related to referral programs and incentives.
• If you’re an Affiliate who’s not a South African citizen (i.e. foreigner), you must refer South African prospects with South African registered businesses.

3. How the Program Works

• Affiliates will receive a flat incentive of R500 for each successful sign-up of a new client to any tier of our bookkeeping services.
• There is no limit to the number of referrals an Affiliate can make, and Affiliates can earn multiple commissions for each successful referral.
• Referrals must be made using the unique referral link provided to each Affiliate.
• The referred client must use the Affiliate’s referral link at the time of sign-up. Referrals made without the proper tracking will not be eligible for the commission.
• Affiliates can refer themselves or anyone in their household as a new client.

4. What counts as a “successful sign-up”

• A successful sign-up is defined as when a referred client completes all of the following steps:
  • The referred prospect visits our website and starts the subscription process.
  • They complete the checkout (i.e., place order) for one of our bookkeeping services.
  • They schedule an onboarding meeting with us.
  • They attend the onboarding meeting where we capture their business requirements.
• What Does NOT Count as a Successful Sign-Up:
• The referred prospect only checks out (i.e., places an order) but does not schedule an onboarding meeting.
• They schedule the onboarding meeting but cancel it afterward.

5. Commission Eligibility and Onboarding Requirement

• If a referred individual cancels their onboarding meeting after scheduling it, Hulisa reserves the right to revoke the affiliate’s eligibility to earn commission for that referral. This measure is in place to prevent fraudulent activity and ensure that only genuine, completed sign-ups qualify for commission payouts.

6 Payment Methods

• Affiliates will be paid via PayPal when eligible for commission.
• PayPal is the recommended and default method of commission payout for affiliates. However, affiliates who prefer an alternative payment method like bank transfer (EFT), are welcome to contact Hulisa to request a special arrangement. Approval of alternative methods is subject to review and may vary depending on location and availability.

7. Payment of Commissions

• The R500 commission will be paid within 30 days and on the following month after the successful referral, provided all conditions have been met.

8. Program Limitations

• The Program only applies to our bookkeeping services and covers all 3 service tiers.
• The R500 incentive is a flat rate and applies equally to all tiers.
• Affiliates are responsible for any taxes or charges that may arise from the payment of the incentive.
• The program is only reserved for clients with South African registered businesses 

9. Fraud or Abuse

Any abuse of the Program — including but not limited to creating fake accounts, fraudulent sign-ups, or manipulating the referral process — will result in disqualification from the Program and forfeiture of any earned commissions. Examples of fraud include, but are not limited to:

• Referred prospects completing the subscription and then canceling it after their “partner-in-crime” affiliate becomes eligible for commission.
• An affiliate pretending to be their own referred prospect by using a different account to sign up; completes the subscription and then cancels it after their affiliate account gets commission eligibility.

We reserve the right to withhold payments and terminate affiliate participation if there is any evidence of fraud or violation of these terms.

10. Program Changes or Termination

• We reserve the right to modify, suspend, or terminate the Program at any time, with or without notice.
• In the event of termination, only referrals made prior to the termination date will be eligible for commissions.

11. Cancellation of Incomplete Orders

• We reserve the right to cancel any incomplete orders if the person who made the order fails to complete it within 10 days of initiating the process. In such cases, the affiliate’s commission for the referral will also be forfeited. This policy is in place to ensure the efficiency and integrity of our program.

12. Compliance with the Protection of Personal Information Act (POPIA)

• We are committed to protecting the privacy and personal information of both Affiliates and referred clients and prospects.
• The personal information collected through the Program will be processed in accordance with the Protection of Personal Information Act, 2013 (POPIA).
• Personal information will be used solely for the purpose of administering the Program, tracking referrals, and processing commissions.
• By participating in the Program, Affiliates agree to the collection and processing of their personal information as per our privacy policy and POPIA requirements.

13. Liability

• We are not responsible for any technical issues, miscommunication, or errors that prevent the proper tracking of referrals or payment of commissions.
• The decision of the company regarding any aspect of the Program is final and binding.
