1. HULISA'S POPIA DECLARATION

Hulisa is a trademark of Luvilne Business Solutions (Registration No. 2017/090763/07).

Hulisa is committed to processing personal information lawfully and responsibly in accordance with the Protection of Personal Information Act 4 of 2013, commonly called POPIA.

This declaration explains the principles Hulisa follows when it determines why and how personal information is processed. It should be read with the Privacy Policy, which provides practical detail about information collected through this website and Hulisa's communication channels.

Public compliance statement

This page records Hulisa's approach and commitments. It does not claim that the Information Regulator has certified, endorsed, or audited Hulisa.

2. ROLES AND ACCOUNTABILITY

Hulisa acts as the responsible party when it determines the purpose and means of processing personal information. Service providers may act as operators when they process information for Hulisa under an agreement or instruction.

Hulisa remains accountable for complying with POPIA and expects team members and operators with access to personal information to preserve its confidentiality and use it only for authorised purposes.

3. CONDITIONS FOR LAWFUL PROCESSING

Hulisa's privacy practices are guided by the eight conditions for lawful processing in POPIA:

  1. Accountability.
  2. Processing limitation.
  3. Purpose specification.
  4. Further processing limitation.
  5. Information quality.
  6. Openness.
  7. Security safeguards.
  8. Data-subject participation.

These conditions guide how Hulisa collects information, explains its purpose, limits its use, keeps it accurate, protects it, and responds to people exercising their rights.

4. PERSONAL INFORMATION AND PURPOSE

Hulisa may process business contact details, enquiry information, assessment responses, client and supplier records, project communications, billing information, website security records, and other information reasonably required for a stated business purpose.

Information is collected for specific and lawful purposes such as responding to enquiries, assessing business needs, preparing proposals, delivering agreed services, administering relationships, keeping required records, protecting systems, and meeting legal obligations. Hulisa does not sell personal information.

5. DATA-SUBJECT RIGHTS

Subject to POPIA and other applicable law, a data subject may ask whether Hulisa holds personal information about them and request access to it. A data subject may also request correction or deletion where appropriate, object to certain processing, or ask that processing be restricted.

Requests should be sent to sales@hulisa.co.za for the attention of the Information Officer. Hulisa may ask for proof of identity and enough detail to locate the relevant record before responding.

6. OPERATORS AND CROSS-BORDER PROCESSING

Hulisa may use operators that support email, hosting, information technology, communications, professional advice, and service delivery. Operators should receive only the information needed for their role and be bound to apply appropriate confidentiality and security safeguards.

Where personal information is processed outside South Africa, Hulisa will take reasonable steps to ensure that the transfer meets the requirements of POPIA, including the safeguards applicable to transborder information flows.

7. SECURITY SAFEGUARDS AND INCIDENTS

Hulisa uses reasonable organisational and technical measures designed to protect personal information against loss, damage, unauthorised destruction, unlawful access, or unauthorised processing. Safeguards are reviewed in light of the information involved, foreseeable risks, and available measures.

If there are reasonable grounds to believe that personal information has been accessed or acquired by an unauthorised person, Hulisa will investigate and notify the Information Regulator and affected data subjects as soon as reasonably possible where POPIA requires notification.

8. RETENTION, DELETION AND QUALITY

Personal information is kept only for as long as reasonably needed for the purpose for which it was collected, a lawful related purpose, an agreed relationship, or a legal record-keeping requirement. When information is no longer required, Hulisa will delete, destroy, or de-identify it where reasonably practicable and lawful.

Hulisa takes reasonably practicable steps to keep personal information complete, accurate, not misleading, and updated where necessary for the purpose for which it is used.

9. DIRECT MARKETING AND WEBSITE DATA

Hulisa will send electronic direct marketing only where permitted by POPIA and applicable electronic-communications law. People may object to or opt out of marketing communications through the method provided in the message or by contacting Hulisa.

The current website does not intentionally use analytics or advertising cookies. The Privacy Policy's website-data section explains the current position and will be updated if non-essential tracking is introduced.

10. INFORMATION OFFICER, CONTACT AND COMPLAINTS

POPIA enquiries and rights requests may be addressed to Hulisa's Information Officer through sales@hulisa.co.za, by telephone on 010-014-8758, or at The Workpods Office G13, 1024 Brand Road, President Park, Midrand, 1685, Gauteng.

A person may also lodge a complaint with the Information Regulator of South Africa. The Regulator's website provides current complaint forms and submission procedures.
